Francisco E. Mundaca is The Mundaca Law Firm’s Founder & Managing Partner. His practice focuses on labor and employment, business law, consulting, and crisis management throughout Washington, D.C., New York, Virginia, Maryland, and Texas.

Within Francisco’s employment law practice, his clientele frequently ranges from C-suite executives, mid-level professionals, high-ranking members of government, physicians, frontline workers, and various types of federal employees. While employment law is incredibly complex, Francisco instills confidence in his clients and guides them through various scenarios, including but not limited to high-stakes severance negotiations and separation agreements, contractual claims, whistleblower claims, risk assessment, sexual harassment, wrongful termination, and aggressive prosecution of actions relating to discrimination and retaliation on the basis of race, age (over the age of 40), color, religion, national origin, sex (including pregnancy, gender identity, and sexual orientation). These claims are commenced through Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and the Family Medical Leave Act (FMLA), among other state and federal statutes.

As part of Francisco’s Business Law practice, Francisco has provided legal support to small and medium-sized organizations at all stages of the business lifecycle, from initial formation to sustainable expansion to winding down. His client's business goals are the key consideration, and he strives to advise his clients with practical solutions to achieve them. Francisco has a long-standing reputation of guiding his clients through a wide range of legal issues that their businesses may face, including protection of intellectual property, insurance matters, records retention, employee relationships, corporate compliance, risk reduction, and others.

Due to his extensive litigation experience, Francisco is uniquely equipped to serve as outside general counsel to his business clients. His business and commercial clients include businesses in a wide variety of industries including business services, retail, restaurant, hospitality, celebrities, professional athletes, pet services, garment industry, entertainment, childcare and children’s recreation, healthcare, manufacturing, and logistics.

Most recently, Francisco Mundaca, served as the Managing Partner, at one of the most prominent Labor and Employment firms in the Washington, D.C., Maryland, and Virginia area. Therein, he served as the firm’s top attorney and an integral part of the firm’s multi-million dollar growth. As Managing Partner, he was the firm’s lead trial attorney, created the firm’s internal legal structure, responsible for selecting all legal personnel, and defended the firm in all adversarial legal matters. Francisco Mundaca has always been an active proponent of providing pro bono assistance. At his former firm, he created various initiatives to help those who are less fortunate. His various licenses and forethought allowed Francisco to expand the firm’s physical presence from Virginia to Maryland, and his licenses provided access to the largest markets. His steadfast counsel has secured millions of dollars for his clients, many of which he remains in contact with today.

Historical
Prior to his attendance at law school, Francisco worked as a Forensic Analyst for a prestigious Computer Forensics firm in New York City. After earning his Juris Doctorate degree, in Washington, D.C., Francisco returned to New York, and began his tenure as an Assistant District Attorney for the Kings County District Attorney’s Office (Brooklyn, NY). Due to his tenacity, Francisco was selected to the Gang Division, an elite group of attorneys within the DA’s office, and tasked with prosecuting gang activity in many of New York’s highest-crime areas. During that time, Francisco was ranked among the top ten percent (10%) of attorneys office-wide. A highlight of his time as a prosecutor included the largest takedown of one gang in Brooklyn history. After a year-long investigation, he successfully indicted forty-two (42) members of a violent street gang for conspiracy to commit murder, assault and robbery. Unique to this prosecution, Francisco and his team used social media to create a timeline for a string of violent felony crimes.

After resigning from the DA’s office, Francisco moved to civil practice and criminal defense. There, he focused on complex litigation and served as outsourced general counsel to businesses, celebrities, and international clientele. He also represented several individuals charged with a variety of felony and misdemeanor matters. Thereafter, Francisco served as a Senior Associate Attorney at two (2) mid-sized firms in Manhattan. In this capacity, he litigated on behalf of New York-area hospitals and physicians in their defense of medical malpractice claims.

As part of his practice in New York and the DMV area, Francisco was selected as the first non-City University of New York (CUNY) graduate to serve as an attorney-mentor in their attorney incubator program. He was selected by the city of New York to provide low and pro bono counsel to City Counsel constituents in Bronx County, and he lectured, in English and Spanish, in NYC public schools to educate students, parents, and faculty, on topics ranging from cyber-bullying to civil rights. Francisco was also extensively involved with nonprofits to educate minorities relating to immigration consequences and how their status may be affected by criminal charges.

Additionally, Francisco has been selected as a prosecutorial volunteer, for Project Safe Surrender, a government-organized community-based initiative geared toward clearing open warrants to reduce case backlogs. He has served as a Board of Director, for Pace University’s Lubin Alumni Association – his alma mater.

Francisco has made numerous appearances as a legal television correspondent in both national and international news broadcasts. He was also recently featured In the Washington Lawyer Magazine for his pro-bono efforts to defend peaceful protestors from unlawful arrest, following the death of George Floyd. Lastly, due to his vast experience, Francisco was selected as an attorney for The Legal Network for Gender Equity.
